These Terms of Use govern your use of the Daymark mobile application, website and related services.

By creating a Daymark account or using Daymark, you agree to these Terms.

1. Daymark

Daymark is a private journalling, reflection and memory application.

Features may include:

  • private journal entries;

  • guided prompts;

  • Inner Weather;

  • Gratitude and Joy reflections;

  • My Compass;

  • photos;

  • voice recordings;

  • tags and suggested tags;

  • On This Day;

  • calendar and journal-history features;

  • reminders;

  • the AI Mirror;

  • monthly and yearly reflections;

  • optional private coaching.

Daymark may add, improve or change features over time.

2. Age requirement

You must be 18 or over to create or use a Daymark account.

By using Daymark, you confirm that you meet this requirement.

3. Your account

You are responsible for keeping your login credentials secure and for activity carried out through your account.

You must not:

  • access another person's account without permission;

  • impersonate another person;

  • interfere with Daymark's security;

  • attempt to bypass access controls;

  • misuse the service.

You should contact us if you believe your account has been accessed without your permission.

4. Your journal belongs to you

Everything you write, record or add to Daymark remains yours.

This includes your:

  • journal entries;

  • answers;

  • photographs;

  • voice recordings;

  • tags;

  • My Compass responses;

  • other personal journal content.

Daymark does not claim ownership of your journal.

You give us only the limited, non-exclusive permission necessary to:

  • store your content;

  • display it to you;

  • sync it where applicable;

  • back it up where applicable;

  • process it to provide features you choose to use;

  • securely transmit selected content to service providers where necessary to provide a feature you request.

We do not receive a right to publicly publish or sell your private journal merely because you store it in Daymark.

We do not use your journal content for advertising.

We do not opt your journal content into general-purpose AI model training.

5. Daymark Plus

Daymark offers free features and may also offer Daymark Plus, a paid subscription.

The current features included with Daymark Plus are shown within the app before you purchase.

Features available through Plus may include enhanced reflection, AI, media, memory and other premium functionality.

6. Free trial

Eligible new subscribers may be offered a 7-day Daymark Plus free trial.

The exact terms of the trial will be shown before you begin it.

Unless you cancel before the trial converts to a paid subscription, your Daymark Plus subscription will begin automatically and your Apple account will be charged the price shown at the time you subscribed.

Private coaching is not included in the free trial.

7. Subscription billing and renewal

Daymark Plus may be offered as a monthly or annual auto-renewing subscription.

Payment is charged through your Apple ID when you confirm the purchase.

Your subscription automatically renews unless you cancel it through your Apple account before the next renewal.

You can manage or cancel your subscription through your App Store subscription settings.

Apple processes payments and refunds according to its own rules and policies.

Deleting your Daymark account does not automatically cancel your Apple subscription.

If you want to stop future subscription charges, you must also cancel the subscription through your Apple account.

If your subscription ends, your journal remains yours and your existing journal content remains accessible to the extent supported by the current version of Daymark, while paid features may become unavailable until you subscribe again.

8. The Mirror and AI

The Mirror and certain other reflections within Daymark are created with the assistance of artificial intelligence.

The Mirror is designed to help you notice patterns, repeated themes, changes, questions and connections across information you choose to make available to it.

AI-generated reflections may:

  • be incomplete;

  • misunderstand context;

  • miss important information;

  • make observations that do not feel relevant;

  • be wrong.

The Mirror does not determine who you are.

It offers a perspective for you to consider.

You remain responsible for deciding whether an observation feels meaningful or useful.

AI features are optional.

9. Daymark is not therapy or medical care

Daymark is a journalling and reflective-wellness product.

It does not provide:

  • medical diagnosis;

  • psychological diagnosis;

  • psychotherapy;

  • psychiatric treatment;

  • medical treatment;

  • legal advice;

  • financial advice;

  • crisis intervention.

The Mirror, prompts, Inner Weather, breathing or reflective exercises should not be treated as professional healthcare or professional advice.

If you are in immediate danger or need urgent help, contact your local emergency service.

In much of Europe, the emergency number is 112.

You may also use an appropriate crisis or support service available in your country.

10. Private coaching

Private one-to-one coaching is available only to active Daymark Plus members.

Coaching is a separate paid service.

It is:

  • not included in your Daymark Plus subscription price;

  • not included in the Daymark Plus free trial;

  • booked separately;

  • paid for separately.

Booking, payment, cancellation and rescheduling terms for coaching are shown when you book.

Coaching is not therapy, medical treatment or crisis support.

Your coach does not automatically receive access to your Daymark journal.

You choose what, if anything, you share before, during or after a session.

If your Daymark Plus subscription is no longer active, you may no longer be eligible to book new Daymark coaching sessions until Plus is active again.

11. Photos and voice recordings

Daymark may allow you to add photographs and voice recordings to your journal.

Photographs are processed before upload in accordance with our Privacy Policy.

Voice recordings remain audio recordings. Daymark does not create transcripts from them.

You are responsible for ensuring that you have the right to upload any media you add to Daymark.

12. Your responsibility for your content

Your journal is private, but you remain responsible for the content you add.

You must not use Daymark to store or transmit content where doing so would itself be unlawful.

Nothing in these Terms prevents you from privately writing about difficult, personal, distressing or sensitive experiences.

13. Acceptable use

You must not use Daymark to:

  • unlawfully access another person's information;

  • interfere with Daymark's infrastructure or security;

  • upload malicious software or code;

  • attempt to circumvent technical restrictions;

  • copy, resell or commercially exploit Daymark without permission;

  • use Daymark for fraudulent or unlawful activity.

We may take reasonable action to protect the service if we detect serious misuse or security threats.

14. Intellectual property

Except for your own content, Daymark's software, design, branding, logo, original prompts, written materials, graphics and other original content belong to Nadege Rachael Rose or the relevant licensors.

You may use Daymark for your own personal use.

These Terms do not give you ownership of Daymark's software, branding or other intellectual property.

15. Privacy

Our collection and use of personal information is described in the Daymark Privacy Policy.

The Privacy Policy forms an important part of how Daymark operates and should be read alongside these Terms.

16. Third-party services

Daymark relies on certain third-party services to provide parts of the service, including services connected with:

  • hosting and storage;

  • AI processing;

  • subscriptions;

  • App Store payments;

  • authentication;

  • email delivery;

  • coaching bookings.

Some third-party services have their own terms and privacy policies.

We are not responsible for third-party services outside our reasonable control.

17. Availability

We aim to keep Daymark available and reliable, but no digital service can guarantee uninterrupted availability.

Daymark may occasionally be unavailable because of:

  • maintenance;

  • technical problems;

  • infrastructure failures;

  • third-party outages;

  • security events;

  • circumstances outside our reasonable control.

18. Changes to Daymark

We may improve, add, remove or change features over time.

Where a change materially affects an active paid service or your legal rights, we will provide notice where required.

19. Deleting your account

You can request deletion of your Daymark account using the account controls provided within the app.

Account deletion removes your Daymark journal information and associated stored media from active systems in accordance with our Privacy Policy.

Deleting your account does not automatically cancel an active App Store subscription.

You must cancel your subscription separately through Apple if you want to stop future renewal charges.

20. Suspension or termination

We may suspend or terminate access where reasonably necessary because of:

  • serious or repeated breach of these Terms;

  • fraud;

  • unlawful activity;

  • security threats;

  • legal requirements.

Where appropriate and legally permitted, we will explain the reason.

21. Disclaimer

Daymark is provided as a journalling and reflective service.

We do not guarantee that:

  • every feature will always be available;

  • the service will always be free from technical errors;

  • AI-generated reflections will always be accurate;

  • Daymark will produce a particular emotional, personal, professional or life outcome.

Nothing in these Terms removes legal guarantees or consumer protections that cannot lawfully be excluded.

22. Liability

To the fullest extent permitted by applicable law, Nadege Rachael Rose is not responsible for indirect or consequential losses arising from use of Daymark or reliance on AI-generated reflections.

You remain responsible for decisions you make based on your journal, Mirror reflections, prompts or other information provided through Daymark.

Nothing in these Terms excludes or restricts liability where doing so would be unlawful.

Nothing in these Terms affects mandatory rights you have under French or European consumer law.

23. Apple App Store

If you obtain Daymark through Apple's App Store, these Terms are between you and Nadege Rachael Rose, not Apple.

Apple is not responsible for operating Daymark or providing its content or coaching services.

Your use of the app is also subject to applicable Apple Media Services and App Store terms.

To the extent required by Apple's applicable terms, Apple and its subsidiaries may be third-party beneficiaries of provisions relating to your use of the App Store-distributed application.

24. Changes to these Terms

We may update these Terms as Daymark changes.

If a change materially affects your rights, we will provide reasonable notice where required, which may include notice within the app.

The current Terms will be available at:

25. Governing law and disputes

These Terms are governed by French law, subject to any mandatory consumer protections that apply in the country where you live.

If you have a problem with Daymark, please contact us first so that we can try to resolve it.

Nothing in these Terms prevents you from using any consumer dispute-resolution process or court available to you under applicable law.
